GNSB Secures Summary Judgment in Construction Defect Litigation

Birmingham, AL – September 8, 2025 – GNSB partners Lisha Graham and Jackson Neal secured a summary judgment for a subcontractor client in a complex construction defect litigation. The case was pending in Jefferson County, Alabama, and involved multiple parties.  Homeowners asserted claims against their general contractor (“GC”) for defective construction, fraud, and breach of contract, among other claims. GNSB’s client was brought in as a third-party defendant by the GC under theories of negligence, indemnity, breach of contract, and declaratory judgment.

GNSB secured summary judgment on all claims and the client was dismissed from the litigation. GNSB’s client was the only subcontractor, among many others, who was able to obtain this result.
